REPORTING ENTITIES TO ANRE. REPORTING CONDITIONS. OBJECTIVES & ANRE COMPETENCIES. ENERGY MARKET PARTICIPANTS' OBLIGATIONS
ANRE has supervisory power over the Romanian energy market by collecting, centralizing, interpreting, and publishing market data/reports, and potentially identifing the need for certain measures to achieve its supervision goals.
These goals include assessing *performance, efficiency, competition, and transparency within the market, while preventing and discouraging **anti-competitive practices, market abuse***, and other actions that could impact the security of the national energy system - within the scope of its competencies.
The results of the monthly monitoring activities are included in public reports and internal briefings, serving as important references for market participants for information and forecasting.
Monitoring results are objectively determined through a set of indicators defined in the methodology (used by ANRE’s monitoring department, OPEE, and OTS).

Market Structure and Concentration Indicators

- Market share of the largest participant – C1 (%)
- C1 > 20%: market concentration concerning;
- C1 > 40%: dominance in the market.
- Sum of the market shares of the top three participants – C3 (%)
- 40% < C3 < 70%: moderate market power concentration;
- C3 ≥ 70%: high market power concentration.
- Herfindahl-Hirschman Index (HHI)**
- HHI tends to 0: perfect competition;
- HHI < 1,000: unconcentrated market;
- 1,000 ≤ HHI < 2,000: moderately concentrated market;
- 2,000 ≤ HHI < 10,000: highly concentrated market;
- HHI = 10,000: monopoly.
Market Efficiency/Performance Indicators
USED BY ANRE (OTS AND OPEE HAVE THEIR OWN INDICATORS TO FOLLOW)
Quantities traded for delivery, weighted average prices per market component, average prices on the Day-Ahead Market (PZU) compared to prices on the Physical Electricity Market (PE)/imbalance prices, export and import on PZU and Intra-Day Market (PI), reported congestion costs, the difference between the PIP on PZU and the average supply price to final customers, ID consumption tranche, etc.
Market Participant Behavior Indicators
1. **Market abuse: use of privileged information, market manipulation, or attempts to manipulate the market (art. 3 and 5 of REMIT).
2. ***Abnormal market behavior: discrepancies between trading intentions (through offers, notifications) and previous behaviors or public data and legal framework.
This supervision imposes corresponding obligations on market participants to submit monthly reports and other daily/periodic/specific reports on their activities.
Monitoring is conducted in collaboration with OPEE and OTS monitoring entities. Depending on the data presented, ANRE may also request additional clarifications, data, and documents.
Market participants listed below are required to notify the ANRE monitoring department as soon as possible after becoming active on any of the PAN components (and possibly PAM, if operating simultaneously) and submit the required reports and clarifications.
Regarding PAN (Wholesale Market) – ENTITIES REQUIRED TO REPORT:
Monitored PAN producer
License holder for the operation of electricity generation capacities (+/- IS) that has a contract with the TSO (for the provision of energy transport/system services, paying the service tariffs + TG for injecting energy into the transport and distribution network).
AGGREGATED ENTITY/AGGREGATOR for production
License holder for aggregation activities or the participant designated by the aggregator.
Aggregated entity/aggregator for electricity production, simultaneously a producer – reports on the monitoring templates for electricity transactions + the monitored PAN producer, regardless of installed capacity or if it is also a supplier.
IS operator (Storage facility)
License holder for the commercial operation of storage facilities that are not added to a production capacity + contract with the TSO for transport services (TG – injecting energy into the network) as mentioned in 1 above.
Reports monthly data on the templates for energy transactions and production data specific to the monitored PAN producer.
Supplier (competitive and FUI/last resport supplier)
license holder for supply activities without any production capacity or holding production capacities outside of the conditions described for monitored PAN producer
The monitored PAN producer, who is also a supplier, reports monthly data on the monitoring templates specific to producers. Additionally, the data/information related to the supply activity will also be reported. Trading activities of suppliers owning power plants with an installed capacity of 5 MW or less are reported on the trading templates.
Trader – license holder for trading activities/foreign legal entity from the EU with confirmation from ANRE to participate in electricity markets in Romania.
BRP – Balancing Responsible Party
If the market participant is registered as a BRP for at least one other participant, it reports monthly data on the monitoring template specific to BRPs.
Distribution Operator (OD)
License holder for electricity distribution (holding a concession contract for the provision of electricity distribution services). It also reports cumulative data on prosumers and small electricity producers connected to the networks in its distribution area, no later than the last day of month L+1.
Transmission System Operator (TSO)
As a participant in the electricity markets, covering the technological consumption of the transmission network and the consumption at its own locations.
Aggregator for CONTROLLABLE CONSUMPTION*
License holder for aggregation activities in balancing and system services markets, with aggregated units composed of multiple controllable consumption locations that have technical dispatch capabilities.
*CONTROLLABLE CONSUMPTION LOCATION – a set of electrical installations at a consumption location that can be actively controlled by a consumption location manager and have technical dispatch capabilities.
Reports monthly data on the monitoring template for electricity transactions specific to the monitored PAN producer
Form of Monthly Reporting to ANRE
Reports are submitted in a monitoring template, following a pre-established model, exclusively in electronic format via ANRE's portal. They must be accompanied by a declaration of responsibility attesting to the complete and accurate submission.
Reporting Deadlines
- For January: by the 15th of month M+2.
- From February onwards: by the 25th of month M+1 for the reporting month.
ANRE, OPEE, and OTS monitor and analyze unusual price values, the impact of legislative changes, and the influence of participants' activities on interconnected markets.
ANRE’s Competencies Based on Monitoring Results
- Propose changes to secondary legislation,
- Undertake control actions,
- Conduct REMIT investigations.
To identify situations involving competition law violations ANRE may request the cooperation of the Competition Council and additionally, for monitoring the functioning of the electricity markets, ANRE may collaborate with the Financial Supervisory Authority (ASF), based on the cooperation protocols established between these institutions.
